ENTRANCE OF TOURIST´S VEHICLES INTO ECUADOR IS REGULATED
On February 11, 2004, the General Manager of the Ecuadorian Customs
Corporation, signed the resolution no. 083, which regulates the Procedure
Manual for the entrance of Vehicles of Tourism into the Republic of
Ecuador.
As the result of an international campaign of protest, organized by the
Motorcycle Touring Commission of the Ecuadorian Motorcyclists Federation and
supported by innumerable motorcyclists and tourist national and
international entities, the Ecuadorian Government modified the articles 82
and 83 of the Customs Law, by means of the executive decree no. 2082, sign
by the President on September 21, 2004.
As consequence of this great victory of common sense and civic action,
tourists entering Ecuador traveling on their vehicles, see facilitated and
simplified the customs procedure to enter and travel across Ecuador with
touristic purposes.
Summarizing the Ecuadorian Customs Resolution no. 083:
The entry and exit of Tourism vehicles can be achieved in any Customs
District of the country.
The delegate of the Department of Control of Primary Zone (delegado del
Departamento de Control de Zona Primaria), is the responsible of the receipt
of the Tourist vehicle.
The owner of the vehicle is to be provided with two ( 2 ) original DJT
forms.
(Declaración Juramentada del Turista, propietario del vehículo)
The Tourist will have to attach copies of: Passport, registration of the
vehicle and drivers license.
Once the information needed is provided in the DJT forms, the delegate of
Control of Primary Zone, will verify the recorded information and will give
one of the forms signed and stamped to the Tourist, keeping the second form
in power of Customs.
The maximum term of permanency in the country of the Tourist vehicle, will
not have to exceed ninety (90) days.
For valid reasons "before the maturity of the term of permanency", the
Tourist will be able to request in writing, to the District Manager closest
customs office, the respective extension of permanency of the vehicle, up to
an equal term to the one authorized initially.
In case of loss or subtraction of the DJT form, the Tourist will have to
"immediately", denounce before the authorities the provoked facts. With the
legalized denunciation, the Tourist will have to approach the most nearby
Customs District and to request the copy of the respective information,
document that will replace the original DJT form.
In the Customs of exit of the country, the delegate of Control of the
Primary Zone, is to verify the information on the DJT form and authorize
immediately the exit of the vehicle, retaining the mentioned form.
If the term of permanency in the country of the Tourist vehicle is overdue,
he or she will have to pay a fine equivalent to the ten ( 10 ) per cent of
the CIF value of the vehicle.
The Customs Authorities will notify to the Police authorities and Control
Organisms, about the vehicles that are circulating in Ecuadorian territory,
out of the authorized period of permanence.
This Resolution is known by the Regional Submanagement, National Management,
District Managements, Department of Foreign Relations and Department of
Tourism, published in the web site of Ecuadorian Customs www.aduana.gov.ec
and also published in the Official Record of the Republic of the Ecuador.

Dear friends:
let me assure you, you DON´T need a carnet for Ecuador.
I suggest using GIRAG cargo. they do Panama - Bogota - Quito.
The bikes will have to switch planes in Bogota, so make sure
you insist on fast delivery of the bikes in Quito.
It`s mandatory to write on the bill of lading, the words:
TOURIST - IN TRANSIT and a note: URGENT DELIVERY - PASSENGERS
WAITING IN QUITO.
Talk to several empoyees at the cargo company, and expalin to them
that you need the bikes in Quito FAST.
All this is to avoid delays in Bogota.
Once you get to Quito, you`ll have the bikes out in a few hours.
I suggest using an agent. The agent I use and that has helped
many bikers is BERTHA IBARRA. She`s a very well know customs agent,
you ask anybody in the customs bulding for her.
Please give a call when you are in Quito, I can go with you to
customs if I`m in town.

On the date of September 21st. 2004, has been published in the Official
Registry of the Republic of Ecuador, the Executive Decree no. 2082, in which
the President of Ecuador, modifies the articles no. 82 and 83 of the Customs
National Law.
This means that tourists entering Ecuador with their own vehicles, cars or
motorcycles, will be no longer required to present the Carnet du Pasage or a
deposit for temporary importation of the vehicle. They will fill up a form
in which the vehicle will constitute enough warranty of it leaving the
country once the tourist is thru with its visit in Ecuador.
This will immensely simplify customs procedures for tourists or racers,
entering with their vehicles by land, sea or air, fact that constitutes a
extraordinary triumph of common sense, of the action of the Touring
Commission of the Ecuadorian Motorcycle Federation, of the Ecuadorian and
international motorcycling community and of the whole country, since this
fact demonstrates how citizen action and pressure over the government can
change inefficient, ridiculous and unfair laws.
Thanks have to be given to the Ministry of Tourism, the Tourist Bureau and
the Foreign Affairs Ministry, but above all, to the Ecuador Moto Turismo
group and the international motorcycling communities of Horizons Unlimited,
www.horizonsunlimited.com, Rutas y Motos, www.rutasymotos.com.ar and to each
and every motorcyclist of Ecuador and the whole world that wrote a protest e
mail to the government authorities of Ecuador. We have to thank as well, to
the Presidency of the Republic of Ecuador, for having the sensibility to
solve this situation.

PRESIDENTE CONSTITUCIONAL
DE LA REPÚBLICA
Considerando:
Que mediante Decreto Ejecutivo No. 726, publicado en el Registro Oficial No
158 de 7 de septiembre del 2000, se publica el Reglamento General a la Ley
Orgánica de Aduanas:
Que los artículo 82 y 83 del Reglamento General a la Ley Orgánica de
Aduanas, establecen que para el ingreso y salida de vehículos particulares
de turistas se debe presentar a la Aduana de entrada, la libreta o carné de
pase por Aduanas o presentación de garantía específica
correspondiente, sin otorgar facilidades para que el propio vehículo
particular de turistas, pueda constituirse en garantía prendaria especial y
preferente a favor de la Corporación Aduanera Ecuatoriana;
Que el artículo 147 del Reglamento General a la Ley Orgánica de Aduanas, no
establece que los vehículos particulares de turistas puedan constituirse, en
garantía prendaria especial y preferente;
Que es necesario establecer los mecanismos idóneos para facilitar el ingreso
de vehículos particulares de turismo, a fin de promover el turismo y dar
cumplimiento con la política del Gobierno Nacional en esta materia; y,
En uso de las atribuciones que le confiere el numeral 5 del artículo 171 de
la Constitución Política de la República,
Decreta:
REFORMAS AL REGLAMENTO GENERALA LA LEY ORGÁNICA DE ADUANAS.
Art. 1.- Al final del primer inciso del artículo 82, luego de la
palabra:"... internacionales" colóquese punto y suprímase la siguiente
frase: "... o la presentación de .la garantía específica correspondiente.".
Art. 2.- Agréguese después del primer inciso del artículo 82. el siguiente
inciso:
"En el caso de los vehículos particulares de turismo, no sujetos a convenios
internacionales, el Distrito de entrada exigirá, como garantía de las
obligaciones tributarias aduaneras, la Declaración Juramentada de Turista
Propietario del Vehículo, consignada en el formulario preestablecido, en el
cual, el vehículo que ingrese constituye prenda especial y preferente a
favor de la Corporación Aduanera Ecuatoriana, tal como lo determina el
artículo 74 de la Ley Orgánica de Aduanas.".
Art. 3.--Sustitúyase el artículo 83, por el siguiente texto:
"Art. 83.- Salida de vehículos de turismo.- A la salida de los vehículos
particulares de turismo, el Gerente del Distrito de salida, hará constar el
hecho en la libreta o carné de pases por Aduana, o cancelará la garantía de
prenda especial y preferente o la tarjeta de pase libre, según
corresponda.".
Art. 4.- Incorpórese después del segundo inciso del artículo 147, el
siguiente inciso:
"En el caso de ingreso, al territorio nacional de los vehículos particulares
de turismo, el vehículo constituirá garantía de prenda especial y preferente
a favor de la Corporación Aduanera Ecuatoriana.".
Art. 5.- La Corporación Aduanera Ecuatoriana, elaborará el formulario,
documento en el cual se establecerá el contenido de LA DECLARACIÓN
JURAMENTADA DE TURISTA PROPIETARIO DEL VEHÍCULO.
Art. 6.- De la ejecución del presente decreto ejecutivo, que entrará en
vigencia a partir de su publicación en el Registro Oficial, encárguese a la
Corporación Aduanera Ecuatoriana.
Dado en el Palacio Nacional, en Quito, a 13 de septiembre del 2004.
